Military law addresses the rights, duties, and responsibilities of military personnel, issues related to military command, economic and business activities of military units and organizations; mobilization and military registration. The team advises government and private organizations in the fields of defense, supporting both day-to-day legal matters and large-scale projects, agreements and disputes. The standout cases include representing Ukrspecexport, a state-owned company for the export and import of military and special purpose products and services, in several international arbitration disputes, and in the bankruptcy case of PJSC Kuznya on Rybalsky Plant. Another area of focus is providing consultation on the reservation of employees and settlement of labor issues in connection with the introduction of martial law and hostilities, issues of keeping military records, in cases of military administrative offenses, advice to the families of fallen servicemen on receiving financial assistance. The Ukrainian office of Kinstellar stands out for its focus on JVs and M&A activity as well as providing ongoing advisory in the defense sector. The team acts for global defense contractors, MRO service providers, dual-use technology companies, multinational organizations, banks and insurers. MORIS has been strengthening expertise in military law right from the start of Russia’s full-scale invasion in 2022. This area of practice involves providing legal support to military units, personnel, and the families of deceased defenders, including representation in certain criminal proceedings related to military law. The team, as led by Andriy Romanchuk, managing partner, acted as legal counsel to the General Staff of the Armed Forces of Ukraine. The firm have been providing legal advice to the Special purpose unit “Azov” and Patronage service “Azov Angels”, advising defenders on the procedure of acquiring the status of a combatant, and providing legal assistance in a big number of cases with reference to the fallen soldiers of Azov. MORIS also initiated creation of the SaveUkraineNow Coordination Center to arrange the centralized purchase of required equipment and other humanitarian aid for Ukrainian fighters. As of now, the team is the main legal counsel to the Center, covering all contractual work with foreign companies. Sayenko Kharenko has actively provided comprehensive legal services in the country’s defense industry. The team has emerged as one of leading legal advisors in this domain, offering strategic counsel on defense procurement, sanctions regimes, export control, and regulatory matters. The area of focus also includes defense tech and raising investments. The team also has a portfolio in obtaining permits for the postponement of military service obligations, namely reservation of employees. The multidisciplinary team includes partners Alina Plyushch, Anzhela Makhinova, and other partners.
ADVANQ is proficient in the complexities of public defense procurement procedures and offers comprehensive legal support for direct emergency defense contracts. In 2022-2023, the team handled, successfully concluded and executed government contracts worth more than UAH 23 billion, including procurement of catering services and food packages, disposable tableware, winter footwear for the Armed Forces of Ukraine. In the summer of 2023, the team supported one of the first procurements under the new procedure developed for the period of martial law. Partner Olga Gonchar is practice head. In the field of military law, Gramatskiy & Partners completed a wide array of projects, including mobilization and conscription matters, leaving Ukraine subject to the condition of return, certain criminal proceedings. KPMG Ukraine has established a specialized team to rapidly engage and facilitate the development of the defense sector. Since the beginning of full-scale invasion, the team has provided services on mobilization, sanctions, labor, migration, taxation and other regulatory issues. The team advises on reserving employees against conscription during martial law and mobilisation within the special legal framework for critical Ukrainian manufacturing concerns and for international technical assistance projects. Cybersecurity is another area of expertise. The key figures are Yuriy Katser, director, and Bogdan Shyshkovskyi, senior counsel, who advises on various regulatory issues in the defense sector.
The focus of Pragma Consulting Group is on GR and regulatory consulting issues. The team worked on settling various issues with regard to humanitarian aid in the draft Law of Ukraine On Amendments to Certain Legislative Acts on Simplifying the Procedure for the Import, Accounting and Distribution of Humanitarian Aid, and also ensured legal and communication support for clients, including retailers, during consideration of amendments to the Law of Ukraine On Mobilization Training and Mobilization, aimed at enlarging the scope of enterprises whose employees are eligible for reservation of conscripts. The team is led by partner Alyona Shulima.
Ukrainian law firm AEQUO[1] is noted for its involvement in the defense industry, having been enlisted in significant projects within this sector. The firm represented Ukraine’s state-owned Ukrainian Defense Industry JSC (formerly Ukroboronprom) in the Antimonopoly Committee of Ukraine on obtaining merger clearance for a joint venture with Rheinmetall AG, one of the world’s leading defense technology companies.
