Ukrainian Medical Center terminated illegal use of the Red Cross Emblem
Ilyashev & Partners successfully represented the Ukrainian Red Cross Society in an action to terminate violations relating to Medicenter Ukraine LLC’s illegal use of the Red Cross emblem.
The specified medical center in Kyiv used the Red Cross emblem with the red cross image in its business activities, including placing it on business signs and within the medical institution’s premises, in advertising of services, on business cards, on the Internet and in social networks as part of its own trademarks.
In its role as a member of the International Red Cross and Red Crescent Movement, the Ukrainian Red Cross Society has a special humanitarian mandate. The Ukrainian Red Cross Society is governed by the Law of Ukraine On the Ukrainian Red Cross Society and the Law of Ukraine On the Red Cross, Red Crescent, and Red Crystal Symbols in Ukraine. According to Ukrainian law and international treaties, the Red Cross Emblem may only be used by the Red Cross Society and its Ukrainian representative offices.
The Intellectual Property team managed to persuade the infringer to stop using the Red Cross emblem and begin rebranding. In a settlement agreement approved by the Commercial Court of Kyiv City on May 28, 2024, the medical center committed to stop using the Red Cross emblem.
The case was handled by Olena Sereda, attorney at law, under the supervision of Mikhail Ilyashev, managing partner. The Ukrainian Red Cross Society was provided with all legal services pro bono.
